When you’re going through a divorce, choosing the right attorney is one of the most important decisions you’ll make. Not all divorce lawyers are the same. They have different backgrounds, levels of experience, and approaches to handling cases. Here is a simple guide to understanding the different types of divorce lawyers.

General Practice Attorneys

Some lawyers dabble in divorce cases even though it’s not their normal area of practice. They might usually handle corporate law or criminal defense but agree to help a friend with a divorce. While their intentions may be good, divorce law can be tricky with legal and emotional issues. Choosing a lawyer who focuses on family law is usually a better idea.

New Attorneys

New lawyers are fresh out of law school and often learning as they go. While everyone has to start somewhere, these attorneys may not have enough experience to handle complex family law issues. If you choose a newer attorney, make sure they have mentorship or support from experienced professionals.

Board-Certified Family Law Attorneys

Board-certified family law attorneys have proven experience and passed a rigorous exam. While this certification shows that they have extensive knowledge, it doesn’t automatically mean they’re the best fit for you. Personality, compassion, and communication skills are equally important.

Litigation-Focused Attorneys

Some attorneys focus on winning in court at all costs. They may tell you what you want to hear, like promising sole custody or a big financial win. Be cautious if a lawyer overpromises outcomes. While it can sound good in the moment, aggressive court battles often leave families emotionally and financially drained.

Attorneys Who Focus on Peaceful Resolutions

Some attorneys take a cooperative approach to divorce. They aim to solve problems through either Collaborative Divorce, Mediation, or Informal Negotiation. This often leads to a smoother process and better long-term outcomes, especially if children are involved. Look for a lawyer who listens to your concerns and helps you create solutions that work for everyone involved, without unnecessary courtroom drama.

Do Higher Fees Mean Better Results?

Some clients mistakenly believe that paying a higher hourly rate guarantees a win. That’s not always true. Just because a lawyer charges $800 per hour doesn’t mean you’ll get better results. A good attorney focuses on your unique needs and finding the best resolution for your case, regardless of their price tag. Make sure you’re hiring someone for their expertise and dedication, not just their fee structure.
